Terms of Service

1. Acceptance of Terms
By creating an account or using Sermon Notes, you agree to these Terms of Service. These Terms work alongside Apple's Standard End User License Agreement (EULA) — linked from Settings and on the App Store listing — which also governs your use of the app. If you do not agree, do not use the app. We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.
2. About Sermon Notes
Sermon Notes is a sermon-recording, transcription, and note-keeping app operated by Simena Digital LLC, a Wyoming limited liability company. It records sermon audio, transcribes it entirely on your device, lets you pin timestamped notes to the recording, exports your transcript and notes to PDF, Word, Markdown, or plain text, shows a daily Bible verse, and — in the Discover tab — lets you browse and import episodes from a curated list of publicly published preaching podcasts.
3. Account Registration
You create an account using Sign in with Apple. Your account holds your subscription status so it can be restored on a new device — it does not hold your recordings, transcripts, or notes (see §5). You must provide accurate information and keep your credentials secure; you are responsible for all activity under your account. You must be at least 13 years old (or 16 in the EEA) to use Sermon Notes.
4. Subscription & Payments
Sermon Notes requires a Pro subscription to use its recording, transcription, and export features — there is no free tier. Purchases are billed through Apple In-App Purchase, and the exact price is shown in your local currency on the App Store subscription screen before you confirm a purchase.
- Weekly plan: $4.99, billed once per week. No free trial.
- Yearly plan: $39.99, billed once per year, and includes a 7-day free trial for first-time subscribers.
- The Weekly and Yearly plans automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- You can manage or cancel your subscription in your iOS Settings under Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refunds are handled by Apple according to their refund policy — we do not process refunds directly.
- Prices may vary by region and are displayed in your local currency in the App Store.
- Restore Purchases is available on the paywall and in Settings, and reattaches your Apple ID's existing purchase to your account.
5. User Content
You own your recordings, transcripts, notes, and onboarding profile answers. As described in our Privacy Policy, this content lives only on your device — it is never uploaded to our servers or to any third party — so we take no license to store or process it. Exporting to PDF, Word, Markdown, or plain text happens entirely on your device; where you send an exported file (Mail, Messages, Files, and so on) is your choice, made through iOS's own share sheet.
You are responsible for the content you record, including complying with any laws in your jurisdiction about recording other people's speech. You may delete any recording, or your entire account, at any time from Settings within the app (see §11).
6. Transcription and Content Accuracy
Transcripts are produced by Apple's on-device speech-recognition engine and may contain errors, omissions, or misheard words — including mistaken Bible verse references. Sermon Notes flags scripture citations that fall outside a valid chapter-and-verse range, but this check cannot catch every transcription error. Treat your transcript as a study aid, not a verbatim official record, and verify anything you plan to rely on against the original recording.
The Discover tab surfaces episodes from publicly published preaching podcasts we do not produce, own, or control (see §7). We make no claim about the accuracy of that third-party audio, and we are not responsible for its content.
7. Third-Party Content and Services
Sermon Notes integrates with the following third-party services:
- Apple: Sign in with Apple for authentication, and In-App Purchase for billing.
- RevenueCat: subscription billing and entitlement management.
- Sentry: crash and error reporting.
Each provider's own terms and privacy policy apply to those interactions. Sermon Notes does not display third-party advertising and does not sell user data.
The Discover tab lets you browse and import episodes from a curated set of publicly published sermon and teaching podcasts (for example, from Desiring God, Gospel in Life, Grace to You, and Truth For Life). We are not affiliated with these publishers; their content belongs to them, and their own terms apply to it. We may add, remove, or change the feeds available in Discover at any time.
Sermon Notes bundles two Bible translations for the daily-verse and scripture-linking features: the World English Bible (public domain worldwide) and the King James Version (public domain in the United States; shown only on the US App Store storefront). Neither translation is our intellectual property.
8. Acceptable Use
You agree not to:
- Use Sermon Notes for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service
- Reverse engineer, decompile, or disassemble the app
- Use automated means to access the service (bots, scrapers)
- Impersonate another person or misrepresent your identity
- Submit content designed to harm, harass, or threaten others
- Upload malicious content or code
9. Intellectual Property
Sermon Notes, including its design, code, features, and branding, is the intellectual property of Simena Digital LLC. You may not copy, modify, distribute, or create derivative works based on Sermon Notes without our written permission. The World English Bible and King James Version text bundled with the app are public-domain works, not owned by us (see §7). Podcast content available through the Discover tab belongs to its respective publishers.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Simena Digital LLC and its officers, employees, and agents shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of Sermon Notes
- Transcription errors, omissions, or inaccuracies, including mistaken scripture references
- Loss of a recording, transcript, or note due to device failure, storage limits, or user error — this content lives only on your device (see §5), so we hold no server-side copy to recover it from
- Service interruptions, downtime, or data loss
- The content or availability of third-party podcasts surfaced in the Discover tab
- Issues arising from third-party services integrated with Sermon Notes
Sermon Notes is provided "AS IS" without warranties of any kind, express or implied. Our total liability to you for any claims arising from or related to Sermon Notes shall not exceed the amount you paid for the service in the 12 months preceding the claim.
11. Account Termination
You may delete your account at any time from Settings within the app. Deletion is soft-applied immediately — your active session is ended and your Apple refresh token is revoked — and finalized after 30 days. During this 30-day grace window you may restore your account by signing in again with the same Apple ID. After 30 days, your account record (name, email, and subscription status) is permanently and irreversibly deleted. Your recordings, transcripts, and notes are unaffected either way, since they live only on your device and never on ours — delete them from your library, or delete the app, to remove them.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose a security risk to other users or the integrity of the service.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of Sermon Notes shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with the rules of the American Arbitration Association.
13. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
